Welcome to DexaFit West Houston’s website. DexaFit West Houston is a DBA of Houston Concierge Medicine & Wellness PLLC and operates as an independently operated location that licenses the DexaFit® trademark and software platform from DexaFit, Inc. and its subsidiaries and affiliates (collectively, "DexaFit Corporate").

These Terms of Service ("Terms") govern your access to and use of the DexaFit West Houston website located at www.dexafitwesthouston.com, including its content, features, forms, online booking links, and other website-based services we make available (collectively, the "Site").

For purposes of these Terms, "DexaFit West Houston," "we," "us," and "our" refer to Houston Concierge Medicine & Wellness PLLC, doing business as DexaFit West Houston, unless the context indicates otherwise.

By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. About DexaFit West Houston

DexaFit West Houston provides health, wellness, fitness, body composition, metabolic, performance, and related assessment services in Houston, Texas.

DexaFit West Houston operates independently from DexaFit Corporate. DexaFit Corporate provides or licenses the DexaFit brand, software platform, analytics, reporting systems, and related technology used in connection with certain DexaFit services and reports.

Houston Concierge Medicine & Wellness PLLC is responsible for the operation of the DexaFit West Houston location, including its local services, personnel, scheduling, equipment, customer interactions, and other local operations.

These Terms govern your use of the DexaFit West Houston Site. Your use of any software platform, application, digital report, or other service operated directly by DexaFit Corporate may also be subject to separate terms and privacy policies provided by DexaFit Corporate.

2. Eligibility and Acceptance

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site independently.

By accessing or using the Site, you represent that you meet these requirements and agree to comply with these Terms and all applicable laws.

Certain services may require additional acknowledgments, informed consents, waivers, policies, or agreements before you may participate.

3. Terms Governing In-Person Services

These Terms primarily govern use of the Site.

Purchases, appointments, testing, assessments, therapies, programs, and other in-person or related services provided through DexaFit West Houston may be governed by additional Terms & Conditions, informed consent documents, waivers, preparation requirements, and other policies.

Our Terms & Conditions are incorporated by reference where applicable to your purchase or use of our services.

If there is a conflict between these Terms and our Terms & Conditions concerning an in-person service, the Terms & Conditions applicable to that service will control.

Our Cancellation and Rescheduling Policy also applies to appointments booked with DexaFit West Houston.

4. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.

When you use certain DexaFit platforms or digital services operated by DexaFit Corporate, information may also be collected or processed under DexaFit Corporate's applicable privacy policy.

5. General Wellness Information and No Medical Advice

Content provided through the Site is intended for general informational and educational purposes.

Unless expressly stated otherwise in connection with a particular service provided by an appropriately licensed healthcare professional, information appearing on the Site is not intended to:

  • diagnose, treat, cure, mitigate, or prevent any disease or medical condition;

  • provide medical advice;

  • replace consultation, diagnosis, or treatment from a licensed healthcare provider; or

  • establish a physician-patient or other healthcare treatment relationship solely through your use of the Site.

6. Information About Testing and Services

The Site may describe services such as body composition testing, DEXA scans, VO2 Max testing, Resting Metabolic Rate testing, movement assessments, 3D body scanning, wellness testing, laboratory services, recovery services, and other health or performance-related offerings.

Descriptions of services are provided for general informational purposes and may not include every eligibility requirement, limitation, risk, preparation instruction, or contraindication.

Actual testing results and measurements may vary based on equipment, software, preparation, hydration, food intake, physical activity, positioning, biological variability, environmental conditions, and other factors.

No information presented on the Site guarantees a particular result, outcome, improvement, diagnosis, or health benefit.

Specific risks, limitations, eligibility requirements, and informed consent provisions associated with a service may be provided separately before or at the time of your appointment.

7. Appointments, Purchases, and Payments

The Site may allow you to access third-party or integrated systems for booking appointments, purchasing services, purchasing packages, or submitting payment information.

You agree that information you provide in connection with a booking or purchase will be accurate and complete and that you are authorized to use any payment method you provide.

Payment processing may be performed by third-party payment processors. DexaFit West Houston does not necessarily receive or store your full payment card information.

Appointments, cancellations, rescheduling, late arrivals, no-shows, refunds, and related charges are governed by our applicable Cancellation and Rescheduling Policy and any additional terms presented at the time of booking or purchase.

When you contact us electronically, submit a form, make a booking, or provide an email address or mobile telephone number, you may receive electronic communications related to your request, appointment, transaction, or use of our services.

Where required by law, separate consent will be obtained for promotional or marketing text messages.

Marketing text-message consent is not a condition of purchasing goods or services.

Additional terms regarding email and SMS communications may appear on the form, booking system, or consent mechanism through which you provide your contact information.

You may unsubscribe from marketing emails using the unsubscribe link provided in the communication.

Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Houston Concierge Medicine & Wellness PLLC, doing business as DexaFit West Houston, and its owners, officers, employees, contractors, agents, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your access to or use of, or inability to access or use, the Site.

This includes damages resulting from reliance on Site content, interruptions, technical failures, errors, omissions, third-party services, or unauthorized access to information where such liability may lawfully be limited.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability arising from gross negligence, willful misconduct, fraud, or other conduct for which limitation is prohibited by applicable law.

Any separate limitation, release, or assumption-of-risk provisions applicable to in-person services are addressed in the Terms & Conditions or applicable informed consent documents.

12. Intellectual Property

Unless otherwise indicated, the Site and its content, including text, photographs, graphics, logos, designs, videos, software, trademarks, service marks, and other materials, are owned by or licensed to Houston Concierge Medicine & Wellness PLLC, DexaFit Corporate, or their respective licensors.

You are granted a limited, revocable, non-exclusive, non-transferable right to access and use the Site for your personal, non-commercial use.

You may not copy, reproduce, modify, republish, distribute, sell, license, create derivative works from, or commercially exploit Site content without authorization from the applicable rights holder, except as permitted by law.

DexaFit and related names, logos, marks, and branding may be trademarks or other protected intellectual property of DexaFit Corporate or its licensors.

Nothing in these Terms gives DexaFit West Houston or Houston Concierge Medicine & Wellness PLLC an unrestricted right to publicly use your personal health information, photographs, testimonials, or other personally identifiable information for marketing.

Any such use will be subject to applicable law and any additional authorization or consent required.

Third-party services are operated independently and may have their own terms and privacy policies.

DexaFit West Houston does not control and is not responsible for the content, security, availability, privacy practices, or operation of third-party websites or services.

A link or integration does not necessarily constitute an endorsement of the third party.

16. Copyright Concerns

If you believe material appearing on the Site infringes a copyright you own or control, please provide sufficient information for us to identify and review the material, including:

  • identification of the copyrighted work;

  • identification and location of the allegedly infringing material;

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Houston Concierge Medicine & Wellness PLLC, doing business as DexaFit West Houston, and its owners, officers, employees, contractors, and agents from third-party claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from:

  • your material violation of these Terms; or

  • your violation of another person's rights.

This obligation does not apply to the extent a claim results from our gross negligence, willful misconduct, fraud, or other conduct for which indemnification cannot lawfully be required.

Unless another applicable agreement provides otherwise, any legal action concerning these Terms that is properly brought in court will be subject to the jurisdiction of the appropriate state or federal courts serving Harris County, Texas.

Nothing in this section limits any right or remedy that cannot lawfully be limited under applicable law.

Any dispute-resolution or arbitration provisions specifically applicable to the purchase or use of DexaFit West Houston services may be set forth separately in the applicable Terms & Conditions.

20. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

21. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

22. Changes to These Terms

We may revise these Terms from time to time.

Changes will apply prospectively after the revised Terms are posted to the Site unless otherwise required by law.

The "Last Updated" date at the top of this page identifies when these Terms were most recently revised.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.

23. Entire Agreement

These Terms, together with our Privacy Policy and any policies incorporated by reference, constitute the agreement between you and Houston Concierge Medicine & Wellness PLLC, doing business as DexaFit West Houston, regarding your use of the Site.

Separate Terms & Conditions, informed consent documents, waivers, cancellation policies, or other agreements may govern your purchase or receipt of DexaFit West Houston services.
